Where to buy a plot of land?

You can buy a plot of land in Ukraine from a private owner or at land auctions, if the sale of a specific plot is permitted by law. Offers are searched for on real estate platforms, through owners and intermediaries, and auction lots — in the Prozorro.Sale system. Before handing over the money, check not only the price and location, but also the seller’s right, cadastral data, the possibility of the planned use, access to the road and communications.

In this article, we focus on choosing a plot for a private house and arranging the territory. Agricultural land has separate turnover rules; the terms “for personal peasant farming” (OSG), “for gardening” and “homestead plot” should not be perceived as interchangeable.

Where to look for a land plot to buy

Search channel What to check
Private owners’ ads Who is the owner, what exact object is being sold, whether the cadastral number matches the documents and the showing location.
Agency or other intermediary Authority to act on behalf of the seller, service conditions, and commission. An intermediary does not replace verification by a notary.
Electronic land auctions The subject of the lot: the plot itself or the lease right. Documents, restrictions, draft contract, contributions, and participation deadlines.
Community notices about auctions The decision and official announcement regarding a specific lot, as well as the possibility of using the plot for your project.

On the “Lease and sale of land” page of Prozorro.Sale you can get acquainted with the direction of land auctions and go to the lots and platforms. Do not confuse the acquisition of land in ownership with the acquisition of lease rights. State and communal agricultural lands are not for sale; for private agricultural land, there are requirements for acquirers and other restrictions.

The presence of an ad in the electronic system does not make any plot suitable for housing and does not cancel the document check. Evaluate a specific lot, not just the starting price. This review is not a rating of agencies or a recommendation of a specific seller.

Target purpose: is the land suitable for a house

Compare your plan with the category and type of target purpose in the cadastre and the urban planning conditions of the territory. The words “for construction” in the ad do not confirm this. For a residential building, check specifically the possibility of its placement, as well as available construction parameters and restrictions.

The rules for establishing and changing the purpose are determined by Article 20 of the Land Code of Ukraine. Do not buy land solely based on the promise “we will easily transfer it later”. The possibility, documents, deadlines, and costs must be clarified for a specific plot before the deal; there is no universal timeframe of “from half a year”.

Ask a specialized expert to check the urban planning documentation, protective and sanitary zones, restrictions near water bodies, and other conditions that may affect the location of the house. Even sufficient area does not mean that the necessary buildings will fit on it.

How to evaluate a plot during an inspection

Area, shape, boundaries, and relief

Try to fit the house, driveway, parking, outbuildings, and maintenance area to the plot. A narrow or complex shape can limit the layout. On a slope, separately evaluate drainage, soil stability, and possible costs for retaining structures. An inspection in dry weather does not show all flooding problems.

Compare actual boundaries with cadastral data. An old fence is not sufficient proof of the correct boundary. In case of discrepancies, involve a certified land management engineer; the issue of disputes is covered in the article about land technical expertise. Expertise and marking boundaries on the ground are different tasks; the required procedure is determined by the situation.

Road and utility networks

  1. Access road. Find out who owns the road and on what basis you will be able to use it. Actual passage through neighboring land does not guarantee legal access.
  2. Electricity. A nearby line does not confirm the possibility of connecting the required power. Get information from the network operator regarding conditions, terms, and costs.
  3. Water and sewerage. Check existing connections or the possibility of an individual solution considering the soil and territory restrictions.
  4. Household infrastructure. Estimate the real time to work, schools, medical facilities, and shops, road conditions in different seasons, noise, and neighboring objects.

Inspect existing buildings and fencing: their documents, condition, possibility of repair, and dismantling. An old fence does not necessarily need to be replaced completely. First, check the boundary, supports, corrosion, and safety of the structure.

Budget after purchase

Compare the full costs: the price of the plot, execution, valuation, and taxes for a specific deal, services of specialists, network connection, territory preparation, dismantling, drainage, and fencing. Exact amounts and their distribution between the parties should be agreed upon in advance.

For a preliminary assessment of the fencing, the perimeter is important, not just the area. Educational example: rectangular plots of 20 × 50 m and 25 × 40 m have the same area of 1000 m², but the perimeters are 140 and 130 m, respectively. This is a difference in length, not a ready estimate: you need to consider gates, a wicket, relief, design, and installation.

What to check in documents and registers

The State Land Cadastre (SLC) and the State Register of Property Rights (SRPR) perform different functions. Cadastral data helps to identify the plot; registry data on rights and encumbrances is needed to check the legal situation. A simple screenshot of the map or a copy of an old document is not enough.

  1. Cadastral number and relevant SLC data: location, area, purpose, information about restrictions. StateGeoCadastre explains the content of the land plot extract.
  2. The seller’s ownership right and its basis: contract, inheritance, state act, or other proper document; it is important to check the entire set, not just demand the act.
  3. Registered rights and encumbrances: mortgage, prohibitions, lease, other rights of use, and conditions for their termination or preservation. The Diia page on information from the SRPR describes obtaining data, including offline through the Administrative Service Centre (ASC).
  4. Identity and authority of the seller: owner’s documents, representation, co-owners, marital status, and necessary consents. The need and form of consent of the spouse are determined by the legal regime of the property; marriage itself does not give a complete answer. For joint property, Article 65 of the Family Code of Ukraine applies.
  5. Circumstances of a specific transaction: disputes, court decisions, condition of buildings, payment method, need for valuation, and additional documents. For an agricultural plot, the requirements for the buyer and the pre-emptive right of purchase are checked separately.

The availability of online services may change: check the current status of the service before ordering. If the required information cannot be obtained online, clarify the available procedure at the ASC or with a notary.

Agree on the list of documents with the notary before paying an advance. General preparation guidelines are provided by the explanation of the free legal aid system; it does not replace checking the current requirements specifically for your deal.

Procedure for buying a land plot

  1. Determine the goal and budget. Choose a settlement or district, the required area, use, and network requirements.
  2. Obtain identification data of the offer. Cadastral number, seller’s documents, information about buildings, and terms of sale. For auctions — a complete set of documents for the lot.
  3. Compare documents with the inspection. Check the purpose, boundaries, road, networks, relief, and the possibility of the planned construction.
  4. Complete the legal check. Involve a notary and, in complex circumstances, a land lawyer. Do not hand over money just for the promise to provide documents later.
  5. Agree on conditions in writing. The object, price, method and terms of settlement, transfer of the plot, expenses of the parties, and consequences of non-fulfillment. Agree on the terms of the advance payment and its return with a specialist before transferring funds.
  6. Conclude a contract and verify registration. Check the cadastral number, area, and other data before signing, get documents regarding the deal and the completed registration.

According to Articles 132 and 125 of the Land Code of Ukraine, a deal on the transfer of ownership of land is executed in writing and notarized, and the right arises from state registration. This is not a procedure for obtaining a new state act in the ASC.

As a general rule, the registration of rights arising as a result of a notarial act is carried out by the notary who performed it, subject to legal exceptions. The procedure under Article 31-2 of Law No. 1952-IV of 01.07.2004 is provided on the website of the Government Contact Center. Before the deal, find out the sequence of actions, and after — make sure that the registration is complete.

Frequently Asked Questions

Is it possible to buy a plot through an ad?

Yes, you can find a seller, but the ad itself does not confirm their authority and right to the plot. Checking the object, documents, and proper execution of the deal is required.

Does a “land auction” mean that land is sold into ownership?

No. The lot may relate to lease rights or other rights. Read the subject of the auction, the draft contract, and the documents before registering to participate.

Is a cadastral number enough for a safe purchase?

No. It helps to identify the plot, but you separately need to check the seller’s rights, encumbrances, boundaries, and the possibility of the desired use.

When to plan the installation of fencing?

After checking the boundaries, rights to the plot, and conditions for placing the fence. For an estimate, prepare the lengths of the sides, elevation changes, locations of gates and wickets, and privacy requirements. Do not substitute checking the boundaries with relying on an old fence.
